Under the terms of this license you are permitted to:

  • Log in to the paxsmart.com website.
  • View, download and print the data you have subscribed to.

You may not yourself, nor may you permit others to:

  • Distribute or share the paxsmart.com Login user name and password.

WARRANTY

As the owner of the license copyright, GMC Research warrants to you only that:

  • The reports and website, when used properly, will provide the functions and facilities as described in the report literature.
  • The warranty is given for a period of 12 months from receipt of the paxsmart.com user name and password.
  • During the warranty period, GMC Research will provide free technical advice, assistance and support by email.
  • In the event of any errors in the reports or website, GMC Research may, at its sole discretion, correct the same.
  • GMC Research does not guarantee that you will have uninterrupted or error free service from this site.

Disclaimer and limitation of liability

You hereby acknowledge that the allocation of risk in this Agreement reflects the price paid for the user license(s) and also the fact that it is not within the control of GMC Research how, and for what purposes, the program is used by you. In no event, therefore, will GMC Research be liable for any direct, consequential, incidental or special damage or loss of any kind (including, but not confined to, loss of profits, loss of contracts, business interruptions, loss of or corruption to data) however caused and whether arising under contract or tort, including negligence or otherwise. If any exclusion, disclaimer or other provision contained in this license is held to be invalid for any reason by a court or competent jurisdiction and GMC Research becomes liable thereby for loss or damage that could otherwise be limited, such liability whether in contract, tort or otherwise, will not exceed the amount actually paid by you for the user license(s).

General

  • GMC Research shall not be liable to you in respect of circumstances outside its reasonable control.
  • Failure by GMC Research to enforce any particular term of this license shall not be construed as a waiver of any of its rights under it.
  • Except for the express warranties contained in section 3 above, GMC Research gives and you receive no other warranties, conditions or representations, express or implied, statutory or otherwise.
